GD Deceased v RLBUH NHS FT – Liverpool

Brought by the widow of the Deceased under the LRA and FAA, the deceased having sadly died as a result of a failure to diagnose and treat TB.

The Deceased presented on more than one occasion with deteriorating respiratory symptoms.  He was X-rayed and swabs were taken.  There were significant delays in reporting on the X-rays and certain of the appearances were misinterpreted.  Swabs taken to be sent to the Lab for cultures to be grown were lost and the request for repeat swabs was overlooked.

Much later, there was a delay in notifying Lab results which confirmed the onset of TB.

The hospital eventually conceded breach of duty and the main battleground related to the level of damages to be paid.  The case eventually settled out of court for substantial damages.
